1. Acceptance of Terms

By accessing or using the Mailflow platform ("Service"), operated by Memphis Network ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Mailflow is a transactional email delivery and monitoring platform that provides email sending via SMTP and API, delivery analytics, queue management, webhook notifications, and related tools for developers and businesses.

3. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must notify us immediately of any unauthorized access to your account.
• You must be at least 18 years old or have the legal capacity to enter into this agreement.
• One person or entity may not maintain more than one account without prior authorization.

4. Acceptable Use

You agree NOT to use the Service to:

• Send unsolicited bulk email (spam) or messages that violate anti-spam laws (CAN-SPAM, GDPR, LGPD, CASL, etc.).
• Send emails containing malware, phishing attempts, or fraudulent content.
• Harvest, collect, or store personal data of third parties without proper consent.
• Impersonate any person or entity or misrepresent your affiliation.
• Interfere with or disrupt the integrity or performance of the Service.
• Attempt to gain unauthorized access to systems or networks connected to the Service.
• Use the Service for any illegal activity or in violation of any applicable law.

5. Email Sending Policies

• All emails sent through Mailflow must comply with applicable anti-spam legislation.
• You must only send emails to recipients who have given proper consent or with whom you have a legitimate business relationship.
• We reserve the right to suspend or terminate accounts that generate excessive bounces, complaints, or are flagged for abuse.
• Sending limits may apply based on your plan and account standing.

6. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any damages resulting from service interruptions.

7. Data Retention

Email metadata (sender, recipient, status, timestamps) is retained for analytics and troubleshooting purposes. Email message content is not permanently stored and is purged after delivery processing. You may request deletion of your data by contacting us.

8. Intellectual Property

The Service, including its design, code, logos, and documentation, is the property of Memphis Network. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

9. Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount paid by you in the twelve (12) months preceding the claim.

10. Suspension and Termination

• We may suspend or terminate your access at any time if you violate these Terms.
• You may terminate your account at any time by contacting us.
• Upon termination, your right to use the Service ceases immediately.
• Provisions that by their nature should survive termination will remain in effect.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated revision date. Continued use of the Service after changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Federative Republic of Brazil. Any disputes shall be submitted to the courts of the State of Sao Paulo, Brazil.
